Under the pre-Conception and Prenatal Diagnostic Techniques (PCPNDT) Act, 1994, prenatal sex determination is banned in India. No test or treatment for sex selection, sex determination, gender selection, gender determination is done in India.

As such, there is no Surrogacy Law in Ukraine applicable for people who are travelling to Ukraine for their surrogacy treatment because the government of Ukraine now understand that surrogacy is nothing but a simple procedure through which many childless couples can fulfil their dream of having an own baby. It’s just a procedure for the couples with the same sex or different sex who wish to have their own baby.

The surrogacy procedure works differently for the couple with same sex and different sex at the network hospitals under We Care Surrogacy. The Surrogacy Law in Ukraine for same-sex couples is that one of the partners needs to provide the sperm which will be artificially inseminated with the eggs of the surrogate mother and she will carry the pregnancy in her womb until the baby birth. The Surrogacy Law in Ukraine for different-sex couples is that, if the eggs and the sperms of intended parents are good enough for fertilization then the fertility expert mix them together using IVF procedure and once the embryo developed it will be placed into the surrogate uterus, however, in case the quality of the sperms is good but the quality of the eggs produced by women is not good enough for fertilization then the fertility expert will use the surrogate mother eggs and fertilized them with the sperm of intended father and once the embryo developed it will be implanted into the surrogate uterus.

Is there any Surrogacy Policy in Ukraine to be signed?

Yes, both the parties need to sign the Surrogacy Policy in Ukraine and this is just a mutual concern to run the process smooth so that no one should be blamed by the end of the procedure. The surrogates need to agree to sign the Surrogacy Policy in Ukraine which states that they will carry the baby for intended parents until the baby birth and after that, they will hand-over the baby to his/her intended parents without any issues. The intended parents also need to sign the Surrogacy Policy in Ukraine where it is written that the intended parents are liable to take all the expenses of the surrogate mother until the baby birth.

When both the parties signed the policy only after that the network hospitals under We Care Surrogacy begins the surrogacy procedure.

How are the Surrogacy Legalities in Ukraine followed?

The Surrogacy Legalities in Ukraine are followed by filing the petition in Court which needs to be done by the intended parents on the third day of the baby born for seeking the permission from Court to be a legal parent of the baby born through surrogacy.

The Court will first review the policy signed between both the parties and then they order the Department of Vital Statistics to issue a new birth certificate which will be in the name of intended parents as the legal parent of the new-born.
